1.2. The customer can contact the online store operator in any of the following ways:

– via the contact form on the online store website.

General rules for using the moodsy online store

2.1. The online store can only be used by persons over 18 years of age.

2.2. Persons under 18 years of age may use the online store with the consent of their parents or legal guardians.

2.3. People registering in the online store and making purchases there provide their personal data and consent to their processing by moodsy on the terms specified in the Privacy Policy.

2.4. In order to confirm the correctness of the data provided during registration in the online store, the customer receives an e-mail asking to confirm the data.

Ordering goods _

3.1. Orders are accepted via the website www.mymoodsy.com

3.2. The goods in the online store are marked in detail. The website contains, among others, information about the properties of the product, its price and the material from which it is made.

3.3. When ordering goods, the customer selects them in a manner appropriate to the given item, specifying in particular the size, color, and, if necessary, also providing other specific information and the number of pieces of the ordered goods.

How to buy in an online store – detailed instructions

4.1. After the customer has selected the goods, click the “Add to cart” icon.

4.2. The product is transferred to the basket, which is visible after clicking on the basket icon in the bar at the top of the page. You can go to the cart by selecting the “Checkout” button, which opens a page showing all the products in the cart.

4.3. After selecting the “Order” option, a page will open where you must enter the Customer’s data necessary to complete the transaction and ship the ordered goods.

4.4. After logging in to the online store, the Customer gains access to additional options in the Customer panel, such as: order history, the ability to check the status of the last placed order, remembering shipping addresses, and the ability to receive current information about products from the store.

4.5. After selecting the delivery method (to the provided address) and entering all necessary data (including possibly invoice data), select the payment method.

4.6. The customer can choose the online payment method or pay for the shipment upon delivery.

4.7. The customer places orders by clicking the “Place order and pay” button.

4.8. After clicking the “Place order and pay” button, and if the Customer has chosen online payment, after making the payment, the Customer is redirected to a page confirming the order, from which he or she can continue shopping or go to the order summary.

4.9. If you choose online payment as the method of payment for the goods, the payment instruction must be made immediately after placing the order. If payment is not received on the account of moodsy or the entities acting as intermediaries in the transaction, the order is not considered correctly placed, which means that the contract will not be concluded and the order will not be completed. In such a situation, you must place a new order.

4/10 At each stage of placing an order, until payment is made, you can cancel the order by ceasing to complete the next steps and leaving the ordering subpage. An order whose submission process is not completed by the Customer will not be completed.

4/11. Immediately after placing the order, an e-mail confirming the order will be sent to the Customer’s e-mail address provided in the login data. In this message, the Customer will receive an individualized order number, which allows, among others: determining the status of the order.

4/12. moodsy may contact the Customer at the e-mail address provided by the Customer or by phone, at the contact telephone number provided by the Customer, in order to clarify doubts, confirm the order or in other matters related to the execution of the order.

Prices

5.1. Prices on the online store website given in Polish zloty are gross prices, including VAT.

5.2. The price of the goods includes shipping costs, the amount of which depends on the selected form of delivery and payment.

5.3. The price given on the website at the time of placing the order is the final price, binding both the customer and moodsy. After placing the order, the price of the ordered goods will not change, regardless of price changes introduced by moods or promotional or sales campaigns launched.

5.4. The moodsy company reserves the right to change the prices of goods available in the online store, introduce new goods for sale, conduct and cancel promotional campaigns on the store’s websites, or introduce changes to them in accordance with the standards of the Civil Code and other legal provisions.

Availability of ordered goods _

6.1. All goods offered in the online store are available goods.

6.2. In exceptional situations, e.g. when many Customers place an order for the same product at the same time, it may happen that the product will not be available. In such a situation, the Customer will be informed that it is impossible to complete the order.

6.3. The product card provides full information about the size range – sizes currently unavailable are also on this list, however, they are clearly marked with a different color than the available sizes and are crossed out. A product in an unavailable size cannot be added to the cart.

Inability to complete the order

If a given product is out of stock or it is impossible to complete the order for another reason, the Customer will be informed by e-mail or telephone about problems with the order and possible solutions.

Delivery method and order processing time

8.1. Goods are delivered all over the world.

8.2. If you choose the “cash on delivery” payment method, the order is processed immediately after it is placed. If you choose one of the online payment methods, the order will be processed after confirmation of the amount due on the moodsy account.

8.3 NOTE: If you choose one of the online payments as a form of payment, the order processing begins after 100% of the amount for the order has been transferred to the account of moodsy or intermediary entities, and from this moment the time within which the goods will be handed over to the Customer should be counted.

8.4. Orders are delivered by the courier company selected by moodsy.

Payment methods for the order

9.1. Cash on delivery: payment is made to the courier upon receipt of the courier shipment by the Customer.

9.2. Transfer: transfers accepted by moodsy are the so-called fast transfers. A feature of fast transfers is that after selecting this form of payment, the Customer is safely redirected to the payment operator’s website and then, from the operator’s website, to the website of the bank selected from the list, in order to transfer money. The payment operation is made between the customer and the selected payment operator.

9.3. Payment card: The customer must have a card enabling payments to be made online (check with the bank that issued the card whether a given card meets this condition). Payment by payment card is made via the przelewy24 website.

9.4. Attention! The Online Store will never send the Customer a message informing that the payment account has changed, along with a request to make a traditional transfer. If the Customer receives such an email – do not make a payment or respond to it, please send an unchanged email to moodsy at the following address: kontakt@mymoodsy.com

Sales agreement

10.1. The information posted on the store’s website www.mymooodsy.com does not constitute an offer to conclude a contract in accordance with the provisions of the Civil Code.

10.2. The contract is concluded in Polish.

Performance of the contract – deadline

11.1. Depending on the type of delivery option chosen by the Customer, moodsy undertakes to deliver the goods to the Customer within 14 business days (in the case of standard shipment) after successfully placing the order. If the goods are out of stock or it is impossible to complete the order for another reason, moodsy will immediately contact the customer and propose possible solutions in the given situation. Working days are counted from Monday to Friday, excluding public holidays. The delivery time of custom-made products is from 10 to 20 business days.

Cost of delivery

12.1. Deliveries are made worldwide

12.2. All orders in our store are orders with an obligation to pay.

12.3. Pursuant to Art. 535 of the Civil Code, the seller undertakes to transfer ownership of the item to the buyer and deliver the item to him, and the buyer undertakes to collect the item and pay the price to the seller;

12.4. After submitting an offer, a customer making a distance purchase who wishes the goods to be delivered via courier is asked to provide:

– Shipping information,

– payment selection,

– contact telephone number, which, at the customer’s request, will be provided to the courier for contact before delivery,

– possible request for a VAT invoice along with invoice data (otherwise a fiscal receipt will be issued);

12.5. Each customer choosing the prepayment method of payment should make a transfer within 7 days using the options connected to the online store www.mymoodsy.com

12.6. We try to ship each item within 7 business days from the date the payment is credited to our account;

12.7. Each shipment is carefully packed and secured, but please check its condition upon receipt at the courier, and please report any damage to the goods to the supplier, who is obliged to prepare an appropriate report – please report any defects to the seller immediately;

Withdrawal from the contract

13.1. The customer has the right to withdraw from the contract of sale of goods within 14 days without giving any reason. The customer is obliged to send the shipment.

13.2. The right to withdraw from the contract expires after 14 days from the date on which the Customer came into possession of the item or on which a third party other than the carrier and indicated by the Customer came into possession of the item.

13.3. To exercise the right to withdraw from the contract, the Customer must submit to moodsy a clear declaration of withdrawal from the contract together with the returned product to the following address: moodsy ul. Żeromskiego 9 60-544 Poznań.

13.4. In order to meet the deadline for withdrawal from the contract, it is sufficient for the Customer to send information regarding the exercise of the Customer’s right to withdraw from the contract before the deadline for withdrawal from the contract, along with confirmation of sending the shipment.

13.5. In the event of withdrawal from the sales contract, moodsy returns the cost of the purchased product to the Customer, immediately, and in any case no later than 14 days from the date on which moodsy approved the exercise of the right to withdraw from the sales contract (the product must be intact, with a set of tags and with proof of purchase).

13.6. The payment will be refunded by transfer to the bank account indicated by the customer.

13.7 Pursuant to Art. 38 points 3 in which the subject of the service is a non-prefabricated item, manufactured according to the consumer’s specifications or serving to meet his individual needs; the customer is not entitled to a return. The record applies to all products from the personalized order.

Complaint

14.1 Please submit complaints to: kontakt@mymoodsy.com

14.2 In the complaint, please specify whether the complaint is based on the Consumer Act, warranty or guarantee, and please describe:

– reporting a defect (fault),

– claim,

– data to which a response is to be sent (of course, if the customer wants to keep the shipping method);

14.3 We will respond to each complaint within 14 days;

14.4 All products are covered by the warranty for a period of 1 year upon presentation of a receipt documenting the date of purchase.

Final Provisions

Each purchased product is accompanied by a proof of purchase. The customer can request an invoice. Moodsy is not responsible for providing incorrect data by the Customer.

15.1. Processing of personal data

The Customer’s consent to the processing of personal data by moodsy is voluntary, however, the lack of consent to the processing of personal data makes it impossible to register in the online store and make purchases there. All information regarding the processing of personal data can be found in the Privacy Policy.

15.2. Processing of personal data for marketing purposes

The customer may consent to the processing of his or her personal data and entrusting it to a third party in order to provide the customer with commercial information from moody, e.g. about promotional campaigns.
